Party Wall etc. Act 1996

The Act came into effect on 1st July 1997 in England and Wales and it sets out a framework for preventing or resolving disputes in relation to party structures, boundary walls and excavations near neighbouring properties.

If you intend to carry out works which involve:

Working on an existing wall, ceiling or floor structure shared with another property
Building on or at the boundary with another property
Excavating near a neighbouring property

You must find out if the works fall within the scope of the Act and serve notices on Adjoining Owners as set out within the Act.

If you carry out works and have failed to serve notices in accordance with the Act if appropriate then these works could result in the works being unlawful and the Adjoining Owner/s could seek a court injunction to stop the works.

At White & Eddy Ltd we can assist you in assessing if your project falls with the scope of the Act and can act as an agent for serving notices required as well as acting as Party Wall Surveyor should a dispute occur.
