The Act came into effect on 1st July 1997 in England and Wales and it sets out a framework for preventing or resolving disputes in relation to party structures, boundary walls and excavations near neighbouring properties.

If you intend to carry out works which involve:

You must find out if the works fall within the scope of the Act and serve notices on Adjoining Owners as set out within the Act. 

If you carry out works and have failed to serve notices in accordance with the Act if appropriate then these works could result in the works being unlawful and the Adjoining Owner/s could seek a court injunction to stop the works.
